Bakery customer claims screw found in her muffin caused her injuries

HOUSTON — A bakery customer is alleging negligence after a screw in a muffin she consumed caused her to require extensive medical treatment. 

Rosa Nely Linnares filed a complaint March 15 in Harris County District Court against Bake N Joy Foods Inc., alleging negligence and products liability. 

Linnares claims in her complaint that she purchased food from Bake N Joy on April 16, 2022. She alleges that a screw was hidden in a muffin that she ate, which caused her to need extensive medical treatment. Linnares claims Bake N Joy's negligence for failing to examine and inspect its food, failing to ensure its food served was fit for consumption and failure to warn her of the dangerous condition. 

She also claims the defendant was negligent for failing to train its employees and manage its premises to prevent dangerous conditions involving food preparation. Linnares alleges she incurred medical treatment expenses, suffered pain, disfigurement, mental anguish and impairment due to Bake N Joy's negligence.

Linnares seeks monetary relief between $250,000 and $1 million, interest and all other just relief. She is represented by Matthew Stano and Jason Brooks of The Stano Law Firm in Humble.
