Wrongful death lawsuit filed over fatal crash with tractor-trailer

HOUSTON - A wrongful death lawsuit has been brought against Curry Heavy Haul over an employee truck driver’s collision that resulted in the death of two individuals last week. 

Jacinto Castro, individually and on behalf of the estates of Melba and Jaelyn Castro, and on behalf of J.C., a minor, filed the suit May 23 in Harris County District Court. Curry Excavation & Site Work and Randy Holcombe are also named as defendants. 

According to the petition, on May 17, 2023, Melba was traveling southbound on Eagle Drive in Mont Belvieu when Holcombe, a driver for Curry, attempted to make a u-turn, causing the crash and death of Melba and Jealyn. 

“The extreme negligence of Defendant and their driver took the lives of Plaintiff Jacinto Castro’s wife and daughter,” the suit states. “Plaintiff J.C., a minor child, was in the back seat of Plaintiff’s vehicle at the time of the incident.” 

The suit alleges Holcombe negligently failed to make a controlled u-turn with no spotter on the roadway, and that Curry negligently entrusted an unqualified driver to drive their front-liner truck. 

The plaintiffs seek a judgment against defendants within the jurisdictional limits of the court but not more than $50,000,000.
