HOUSTON — A man who was injured while shopping for a trailer at a business in Houston is claiming negligence.

John McClure filed a complaint May 16 in Harris County District Court against Trailer Wheel & Frame Company alleging premises liability and negligence.

McClure claims he was at the defendant's business in Houston on May 17th and 18th to purchase a new trailer when he suffered a fracture to his thumb after a spring popped off a trailer. He further claims that he had a protective "cast-like" bandage on the thumb and when he returned to the defendant's business the next day, the wooden chair he sat in, broke. McClure alleges that as he tried to break his fall from the chair, his injured thumb suffered a complete break.

He claims the defendant failed to provide adequate warnings of the dangerous conditions and that they knew or should have known of the loose trailer spring and unstable chair. McClure claims the defendants were also negligent for failing to repair or replace the dangerous conditions.

McClure seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Larry Littleton of The Littleton Law Firm in Houston.
