Resident alleges breach of contract over fence dispute on property

HOUSTON — A Galveston County man is alleging breach of contract over a fence dispute on his property.  

John Parker filed a complaint May 16 in Galveston County District Court against Lingo Properties Inc., alleging breach of contract. 

According to Parker's complaint, in September of 2022 he and the defendant began to negotiate a disputed property line and existing fence which he believed marked his property line. He claims that he and the defendant discussed the removal of the existing fence and construction of two new fences and in October of 2022, they entered into a written agreement.

Parker alleges the agreement included the defendant moving the existing fence and building a "hog panel" fence along with a privacy fence. He claims the defendant removed his fence but put a lower quality fence in place and at the incorrect height per the agreement. Parker alleges the defendant has failed to fully perform the obligations under their contract and that he has incurred the expense to construct the proper fence at a cost of $8,700.

Parker seeks monetary relief, interest and all other just relief. He is represented by Attorney Marybeth Nelson in Houston.
