Suit alleges security guard suffered traumatic brain injury at Floor and Decor

HOUSTON — A security guard alleges she suffered a traumatic brain injury while working at a Floor and Decor distribution center. 

Theresa Jones filed a complaint June 20 in Harris County District Court against Floor and Decor Outlets of America Inc., Swift Transportation Co., of Arizona LLC and Sanford Holloway, Jr., alleging negligence. 

Jones, according to her complaint, was employed by Metro One Loss Prevention Services as a security guard and was working at the Floor and Decor distribution center in Baytown on March 3, 2023. She alleges that she was ensuring all trucks were properly sealed before being sent out, when Holloway, who was working for Swift Transportation, unlatched the doors of the trailer and forgot to secure the door so that it would stay open. 

Jones claims the unlatched door blew open, swung shut and "violently" struck her in the head and caused her to lose consciousness. Jones further claims she suffered a brain injury as well as injuries to her arm, eye, face, back and neck. She alleges the defendants' negligence for failing to oversee safety in the workplace and for failing to properly train and supervise its employees. 

Jones claims Holloway's negligence for failing to follow safety policies and procedures. She also alleges the defendants failed to warn of the dangerous condition and violated OSHA regulations and standards. 

Jones seeks monetary relief of more than $1 million, interest and all other just relief. She is represented by Marcus Spagnoletti of The Spagnoletti Law Firm in Houston.
