Workers suffer injuries after toxic chemical leak, suit alleges

HOUSTON — Workers who suffered injuries from toxic chemical exposure from a leak at a nearby chemical plant are claiming negligence. 

Joe Hernandez and Danny Williams filed a complaint June 27 in Harris County District Court against Rohm and Haas Chemicals LLC, Edward Heins, Jr., Alan Haggadone and Ray Russell alleging negligence. 

The plaintiffs allege in their complaint that they were working at their jobs in La Porte Texas on July 21, 2021. They claim that a tanker at the nearby Rohm and Haas Chemical's Bayport Plant released a hazardous chemical, hydroxyethyl acrylate, which traveled to their work area. The plaintiffs further claim that they were exposed to and inhaled the toxic chemicals which caused injuries to their nervous system, eyes, throats and lungs. 

They allege the defendants' negligence for failing to properly inspect and maintain the tanker and monitor the safety in the workplace. They also allege the defendants were negligent for failing to follow standard operating procedures and failing to properly train and supervise its employees. The plaintiffs claim the defendants also violated OSHA regulations and failed to warn of the hazard or shut off or stop the release of the toxic chemicals. 

The plaintiffs seeks monetary relief of more than $1 million, interest and all other just relief. They are represented by Marcus Spagnoletti and Eric Rhine of The Spagnoletti Law Firm in Houston.
