Contract worker alleges lack of safety caused him to be struck by crane

HOUSTON — A contract worker at a chemical plant construction site who was struck by a crane is claiming negligence. 

Eduardo Trevino filed a complaint June 27 in Harris County District Court against The Manitowoc Company Inc., Lyondell Chemical Company and H&E Equipment Services Inc., alleging negligence. 

Trevino alleges in his complaint that he was working at Lyondell's construction site on July 11, 2021. He claims that he was inside the structure when a Manitowoc crane fell over, hit a structure and then struck him and caused him to suffer injuries. 

Trevino alleges the defendants' negligence for failing to properly maintain and service the crane or supervise and inspect for hazards. He also alleges the defendants are negligent for failing to warn of the known condition or screen, hire and train crane operators. 

Trevino claims the defendants entrusted the crane to the care of untrained individuals and did not maintain a safe work environment for contractors at its facility.  

Trevino seeks monetary relief of more than $1 million, trial by jury and all other just relief.
