Husband refuses to return borrowed car lent to late wife, suit claims

GALVESTON — A man alleges he lent his friend his vehicle and after her death, her husband refuses to return the car. 

Larry Denson filed a complaint June 22 in Galveston County District Court against Patrick Hines alleging trespass, theft and other claims. 

Denson, according to his complaint, lent his co-worker and friend, Michelle Hines Wignall, his Honda CR-V in September of 2022 who then died in a house fire in January of 2023. He claims on the same night of the fire, Hines, unlawfully removed his Honda from the Wignall's rental home. Denson claims that despite a formal written demand for the return of his vehicle, Hines refuses to return his car. 

He also claims that he is not aware of any probate for Wignall's estate that has been opened. Denson alleges that he temporarily loaned his car to Michelle Hines Wignall and that after her death, he has a right to the possession of his vehicle as the legal owner. 

He further alleges that Wignall's removal of his Honda was theft and that Wignall had the intent to deprive him of the use and enjoyment of his vehicle. 

Denson seeks monetary relief, interest, trial by jury and all other just relief. He is represented by Jason Oxner and Morgan Riemer of Oxner Legha PLLC in Jersey Village.
