GALVESTON — A couple allege a home seller fraudulently represented that proper roof repairs were made to the property they purchased.
Warren Pistillo and Tamara Pistillo filed a complaint July 26 in Galveston County Distrcit Court against Jean Merlin-Tankoua alleging fraud and other claims.
The plaintiffs, according to their compliant, purchased a property on San Luis Pass Road in Galveston on Feb. 6, 2022, from the defendant. They claim that an inspector found numerous deficiencies with the exterior "new roof" on the home and found the representations in the disclosure notice showed a new roof in 2021.
The plaintiffs further claim that the inspector found the roof covering materials were the original from when the home was built in 2011. They allege the defendant agreed to repair the deficiencies through an amendment in the sale contract so they closed on the property in March of 2022. The plaintiffs claim that after one week of ownership, water began to puddle in the home with the water intrusion becoming progressively worse and resulting in damage to the home. They further claim the repair work the defendant promised consisted of "ineffective patch work."
The plaintiffs seek monetary relief between $250,000 and $1 million, interest and all other just relief. They are represented by Christopher Johnson and Jordan Corn of Johnson & Associates PLLC in League City.
