HOUSTON — A patron at a Houston towing yard is claiming negligence after a large metal door suddenly slammed shut on her body with an employee allegedly refusing to call for emergency medical help.

Eleana Mosley filed a complaint Sept. 12 in Harris County District Court against Euro Star Wreckers LLC alleging negligence.

According to Mosely's complaint, she was at the defendant's towing yard in Houston on Dec. 28 2021. She claims that as she was walking through a large metal door, the door suddenly and rapidly slammed shut on her body without warning and trapped her foot. She further claims that as she approached other patrons to help her, a Euro Star employee began to shout offensive language at her and failed to call for emergency medical services. Mosely alleges Euro Star's negligence for failing to monitor the condition of the door and properly train its employees who had actual knowledge of the defective door. She also alleges the defendant's negligence for failing to warn of the dangerous condition or inspect the premises. Mosely claims she suffered pain, mental anguish, lost earnings, impairment, disfigurement and incurred medical treatment expenses.

Mosely seeks monetary relief of $1 million or less, interest and all other just relief. She is represented by Richard Hinojosa and Daniela Fuentes at Hinojosa Law in Houston.
