Man alleges Discover Bank, law firm made false representations regarding debt settlement

GALVESTON — A Texas man alleges Discover Bank and its law firm made false representations regarding a settlement agreement. 

Thomas Brewer filed a complaint Sept. 12 in Galveston County District Court against Rausch Sturm LLP and DFS (Discover) Services LLC alleging violation of the Deceptive Trade Practices Act and other claims. 

According to Brewer's complaint, Discover Bank filed suit against him in January of 2023 with his attorneys coming to an agreement with Rausch Sturm and Discover for $11,096.78 in April of 2023. Brewer claims that in May of 2023, an attorney from Rausch Sturm sent him an email communication regarding a motion for continuance and an apology for not yet sending settlement agreement documents. 

He alleges in June of 2023, on the eve of the trial, Rausch Sturm had never sent him the proposed settlement agreement and that they informed his attorney the settlement needed to be over $1,500 higher than originally agreed upon. According to Brewer's complaint, the case went to trial with Discover and Rausch obtaining a final judgement for the full balance sought. He claims the defendants violated the Fair Debt Collections Practices Act by using false representations to collect consumer debt.  

Brewer seeks monetary relief, trial by jury, interest and all other just relief. He is represented by James Foley of The Ciment Law Firm PLLC in Katy, Texas.
