Car owner sues Take 5 Oil Change for allegedly forgetting to put oil in vehicle

HOUSTON – A man has filed a lawsuit against Take 5 Oil Change, claiming that the company forgot to put oil in his car during an oil change, severely damaging his vehicle. 

Plaintiff Floyd Ravenfell filed the lawsuit in the Harris County Circuit Court against Take 5, LLC, doing business as Take 5 Oil Change #0542, citing breach of contract, implied warranty of workmanlike services, breach of the duty of good faith and fair dealings, fraud, and violations of the Texas Deceptive Trade Practices Act.

According to the lawsuit, on Aug. 23, 2022, Ravenfell took his vehicle to a Take 5 Oil Change #0542 to receive an oil and filter change. Ravenfell alleges that after leaving the location, he noticed that his vehicle was making a knocking noise. and drove to the nearest Take 5 Oil location, which was different than the location he originally went to. The mechanics at the second Take 5 Oil Change facility reportedly told Ravenfell that there was no oil in the engine and that the mechanics at Take 5 Oil Change #0542 had drained the oil but forgot to replace it with new oil. Ravenfell then took his vehicle to a dealership, where specialists determined that the engine would have to be replaced and that his vehicle was no longer safe to drive.

Ravenfell claims that the defendant has refused to compensate him for the damages to his vehicle. He claims that by failing to compensate him for unworkmanlike services, the defendant has breached the contract, breached the implied warranty of workmanlike services, breached the duty of good faith and fair dealings, committed fraud and committed violations of the Texas Deceptive Trade Practices Act.

Ravenfell is seeking damages in excess of $100,000, plus court costs, interest, attorney's fees, and any other relief the court deems proper. He is represented in this case by attorneys Abraham Garcia, Brandon A. Kinard, and Carlos A. Saldana of KGS Law Group in Houston.
