Texas Telecom company files lawsuit against R&A Road Boring for underground cable damage

Frontier Communications of Texas has filed a lawsuit claiming that R&A Road Boring struck underground cables and caused more than $165,000 in damages during a botched water line installation. 

Plaintiff Frontier Southwest Incorporated, doing business as Frontier Communications of Texas, Inc. ("Frontier"), filed the lawsuit in the District Court of Harris County against R & A Road Boring, LLC ("R&A"), citing trespass, negligence, negligence per se, negligent hiring, negligent supervision, and negligent training.

According to the lawsuit, on or around January 6, 2022, near Crosby, Texas, underground cables belonging to Frontier were damaged when R&A was installing a water line and inadvertently struck the cables. This incident caused Frontier to incur expenses for repairing or replacing the damaged utilities, disrupting essential telecommunications services.

Frontier is pursuing two key causes of action in this lawsuit, including trespass and negligence. Frontier alleges that R&A failed to properly locate and avoid damaging Frontier's underground cables, leading to unauthorized interference and harm to the company's facilities. Frontier adds that R&A breached its duty to exercise reasonable care during its activities, including ignoring critical locate rules and damaging Frontier's cables.

Frontier is seeking $165,602.55 in damages, plus interest, court costs, and any other relief the court deems proper. They are represented in this case by attorney Robert J. Palmer of Fox Rothschild, LLP, in Dallas.
