WACO - Earlier this week, a Texas federal court shipped a patent lawsuit against LinkedIn to California.
Alleging infringement, Gatekeeper Solutions filed suit against LinkedIn on July 20 in the U.S. District Court for Western Texas, Waco Division.
According to the complaint, on May 12, 2015, patent No. 9,032,038, entitled “Recipient control system for ensuring non-conflicting and comprehensive distribution of digital information and method thereof” was duly and legally issued by the U.S. Patent and Trademark Office.
Court records show that on Oct. 16 LinkedIn filed a motion to dismiss for improper venue, or in the alternative, to transfer to the Northern District of California.
“In its Complaint, Plaintiff asserts baseless venue allegations and deficient allegations for its infringement claim,” the motion states. “This Court has already decided that LinkedIn is not subject to venue in this District.”
Court records show Gatekeeper opposed the motion to dismiss but agreed to the motion to transfer.
On Monday, the court denied the motion to dismiss but granted the motion to transfer the case to the Northern District of California.
