HOUSTON - A lawsuit alleging gross negligence and wrongful death has been brought against R&A Road Boring, LLC.
Marlenne Palacios, as next friend of minor N.M., the son of the late Erasmo Martinez, filed the suit on Dec. 1 in Harris County District Court.
According to the lawsuit, on Aug. 9 Martinez was doing work for Defendant R&A Road Boring. Defendant was digging drainage when an excavator hit a power pole and knocked the line onto Martinez. Martinez was transported to the hospital, where he was declared dead.
“Defendant failed to ensure that job hazards were properly addressed,” the suit states. “Defendant also failed to ensure that its work crew was properly trained. Defendant was aware of the dangers associated with the work, yet entirely failed to take precautions to protect its workers.
“Due to this tragic incident, minor N.M. will grow up without his father. Plaintiff brings this lawsuit on behalf of her minor son, to recover damages.”
The plaintiffs are seeking more than $1 million in damages.
