HOUSTON - Attorney Tony Buzbee, who wants to be mayor of Houston, took a shot at the city’s crime rate in a civil complaint brought over an alleged assault at a restaurant.

Represented by Buzbee, Genaro Alvarez Aleman filed suit against Captain Tom’s Seafood & Oyster Bar on Jan. 12 in Harris County District Court.

Under the background section, the suit states the litigation was brought because of an aggravated assault that occurred at Captain Tom’s on Sept. 2, 2023.

“Houston crime is out of control,” the suit states. “Almost as soon as offenders are locked up, they are released. Many of those released are violent offenders. People in the city are not safe. They don’t feel safe. And some places in the city are worse than others – much worse.

“The Defendant’s establishment, the so-called “Captain Tom’s,” is in one of those places.”

The suit accuses the defendant of continuing to serve Aleman’s assailants beer despite them being visibly intoxicated and becoming aggressive toward him.

“As Plaintiff was in his truck at Captain Tom’s parking lot, Assailants followed Plaintiff and dragged him out of his truck and began attacking him brutally,” the suit states. “Plaintiff was kicked and beat by approximately fifteen men…”

The plaintiff is alleging gross negligence and seeks at least $1 million in damages.
