HOUSTON - A healthcare provider is suing a Houston attorney for his alleged “scheme to defraud (its) rightful share of settlement funds,” states a recently filed lawsuit.
Asserting breach of contract, Gulf Gate MRI filed suit against Roy A. Boujaoude and the Law Office of Roy A. Boujaoude on May 3 in Harris County District Court.
According to the lawsuit, from 2017 until 2023 Boujaoude referred injured clients to Gulf Gate MRI. The company required each patient who was the attorney’s client to execute an assignment of benefits and claims, which authorized payment from any recovery or settlement proceeds from lawsuits.
“Plaintiff would show that Defendants materially breached the agreement with Plaintiff for the … payment of its assigned interest for medical services from the client settlement funds of personal injury clients,” the suit states, adding that the Boujaoude “did unlawfully convert Plaintiff’s assigned interest… to his own use.”
Gulf Gate MRI is seeking $500,000 in actual damages, $500,000 in exemplary damages, and $25,000 in attorney’s fees.
