HOUSTON - A man is alleging he slipped and fell near a Whole Foods salad bar after a security guard who was allegedly beating a homeless man pushed him for trying to stop the attack.
Seeking up to $250,000 in damages, Brent Baresh filed suit against Whole Foods Market and Tri Shield Security & Investigations on May 6 in Harris County District Court.
According to the lawsuit, on July 17, 2022, Baresh and his wife were checking out of a Whole Foods on Westheimer Road when he heard yelling at the salad bar, where a security guard was screaming at a homeless man.
“The store security guard jumped on the homeless man, and Plaintiff saw him pounding the homeless man in the head, and saw the homeless man’s head being bounced off the floor repeatedly,” the suit states. “Plaintiff and another Whole Foods patron went to try and help the homeless man. The floor by the salad bar was wet with spilled olive juice from the commotion.
“Suddenly and without warning, the store security guard pushed Plaintiff, causing him to slip on the wet floor, causing the damages and injuries complained of herein.”
Baresh alleges the defendants negligently failed to keep patrons from being assaulted by security.
