HOUSTON - A March 2025 trial has been slated in a lawsuit claiming a Bar Louie waitress dropped a heavy skillet on a woman’s head from the second floor.
Jessica Smith filed suit against BLH Acquisition (Bar Louie) on Jan. 18 in Harris County District Court.
According to the lawsuit, on July 23, 2022, Smith was dining with her husband and friends at Bar Louie at Baybrook Mall. They were seated on the lower floor. Right above them was a second floor with a balcony.
“(Smith) had just ordered her drink when she felt a sudden impact on the top of her head,” the suit states. “A waitress had dropped a heavy skillet… from the floor above, causing her to suffer painful and seriously bodily injuries as a result.”
Court records show Bar Louie answered the suit on Feb. 19, asserting a general denial.
A week later, a docket control order was entered, slating the case for trial on March 3, 2025.
The suit alleges Bar Louie was negligent for failing to place caution signs, and for failing to place barriers to prevent customers from unwittingly being exposed to an unreasonable danger.
Smith asserts she suffered permanent personal injuries and is seeking damages for her pain, mental anguish, lost wages, impairment, medical expenses and disfigurement.
