Shopper trips on cart in middle of aisle, sues Fiesta Mart

HOUSTON - Fiesta Mart has been hit with a lawsuit claiming a shopper tripped over a cart in the middle of an aisle. 

Alleging negligence and premises liability, Samuel Olvera filed the suit on May 29 in Harris County District Court. 

According to the lawsuit, on Nov. 3, 2022, Olvera was at a Fiesta Mart in Katy. He was in the canned food section when he proceeded to turn backward and tripped over a cart that was in the middle of the aisle. 

Olvera fell backward onto the floor, violently, and the cans from the cart fell on top of him, the suit alleges. 

He asserts Fiesta Mart failed to ensure it did not have carts that posed harm, and failed to use ordinary care by allowing the cart to be left unattended.  

Olvera is suing for his pain, impairment, lost wages, disfigurement, mental anguish and loss of enjoyment of life.
