Texas resident sues home improvement giant over fallen box

A Texas resident has filed a lawsuit against a major home improvement retailer, alleging severe injuries due to negligence on the company's premises. Mary McKinnon Edwards filed the complaint in Harris County District Court on May 29, 2024, accusing Home Depot Product Authority, LLC of failing to ensure the safety of its store environment.

According to the court documents, Edwards claims that on March 13, 2023, she was walking down an aisle at the Home Depot located at 21530 TX-249 in Houston when a box suddenly fell from a shelf and struck her head. The incident allegedly caused her "severe, excruciating, and painful debilitating injuries." Edwards asserts that she was an invitee on the premises and that Home Depot had a duty to exercise ordinary care in maintaining a safe environment for its customers.

The plaintiff's petition outlines several specific accusations against Home Depot. These include failing to prevent boxes and other items from falling off shelves, not securing merchandise properly, inadequate construction of shelving units, and insufficient maintenance and inspection of the store premises. Additionally, Edwards accuses Home Depot of failing to warn her about the dangerous condition of their premises and not training their employees adequately to manage these risks. "Defendant owed a duty to Plaintiff to exercise ordinary care in ownership, possession, control, maintenance, and use of Defendant’s premises," states the complaint.

Edwards is seeking actual damages exceeding $250,000 but not more than $1 million. She requests compensation for past and future physical pain and mental anguish, loss of earning capacity, disfigurement, physical impairment, medical expenses, and out-of-pocket economic losses. Furthermore, she seeks both prejudgment and postjudgment interest as allowed by law.
