Plaintiff alleges negligence against transport company after workplace injury

A Texas resident has filed a lawsuit against a transportation company, alleging severe negligence that led to significant personal injuries. The complaint was filed by Anthony Doyel in the District Court of Harris County on July 12, 2024, targeting R&A Transport, Inc.

According to the filing, Doyel was working for Vulcan Materials Company on June 11, 2024, when an incident involving one of R&A Transport's drivers occurred. The driver allegedly left a valve open on the truck during unloading operations, causing hot oil to spill over Doyel and resulting in severe burns. The plaintiff claims that this incident was due to multiple forms of negligence on the part of R&A Transport and its employees.

The lawsuit outlines several allegations against R&A Transport. These include failing to fix or warn about dangerous conditions, vicarious liability for their employee’s negligence, knowingly disregarding inherent dangers, and failing to take adequate precautionary measures. Additionally, the complaint accuses the company of recklessly failing to ensure the safety of its equipment and not adhering to applicable government safety regulations. As a result of these alleged failures, Doyel suffered severe physical injuries and emotional distress.

Doyel is seeking monetary relief exceeding $1 million for his injuries and losses. He argues that his physical pain, mental anguish, and other medical problems will likely continue indefinitely. Furthermore, he has incurred significant pharmaceutical and medical expenses and lost earning capacity due to his injuries. In addition to compensatory damages, Doyel is also seeking exemplary damages due to what he describes as reckless disregard by R&A Transport for his safety.

The case is being handled by attorneys Jason A. Itkin and Trenton A. Shelton from Arnold & Itkin LLP. The case has been assigned Case ID 2024-43694 in the 80th Judicial District Court of Harris County.
