A slip-and-fall incident at a local grocery store has led to a lawsuit seeking substantial damages. On August 2, 2024, Julie Aguilar filed a complaint in the District Court of Harris County against Fiesta Mart L.L.C., alleging negligence and premises liability.
According to the court documents, Aguilar claims that on July 22, 2024, she was shopping at Fiesta Mart located at 9419 Mesa Drive in Houston when she slipped on water that had accumulated on the floor. The fall resulted in severe injuries for Aguilar. She asserts that there were no warning signs or other indications of the hazardous condition. Aguilar alleges that Fiesta Mart either created the dangerous condition or failed to address it adequately, thereby neglecting their duty to maintain a safe environment for customers.
The plaintiff argues that Fiesta Mart should have known about the unsafe condition and taken steps to either rectify it or warn patrons like herself. "Defendant knew or should have known of the unreasonably dangerous condition and neither corrected nor warned Plaintiff of it," states the petition. Aguilar contends that her lack of awareness of the hazardous situation contributed to her inability to avoid injury.
Aguilar's lawsuit accuses Fiesta Mart of several forms of negligence, including failing to maintain safe premises, neglecting to inspect areas where dangers might exist, not taking reasonable measures to correct such conditions, and failing to inform customers about potential hazards. Each act of negligence is claimed to be a proximate cause of Aguilar's injuries and subsequent damages.
In terms of relief sought, Aguilar is asking for monetary compensation amounting to $250,000 or less, excluding interest and additional legal costs. She lists various forms of damages she has suffered due to the incident: past and future medical expenses, pain and suffering, mental anguish, physical impairment and disfigurement, as well as lost wages and diminished earning capacity.
Represented by Jonathan Webster from Daspit Law Firm PLLC, Aguilar seeks judgment against Fiesta Mart for an amount within the jurisdictional limits of the court along with pre-judgment and post-judgment interest. The case will be presided over by Judge Bernitta Barrett under Case ID 2024-49327 in Harris County's 61st Judicial District Court.
