A Texas woman has filed a lawsuit against a prominent shopping outlet, alleging severe injuries due to hazardous conditions on the premises. Amanda Yeoh lodged her complaint against SPG Houston Holdings, L.P., doing business as Houston Premium Outlets, in the District Court of Harris County, Texas, on August 1, 2024.
According to the court documents, the incident occurred on April 16, 2023. Yeoh claims she was walking through the Houston Premium Outlets when she tripped and fell due to a gap in the concrete pathway leading to the parking lot. The fall resulted in both of her ankles being broken. Yeoh asserts that there were no warning signs or hazard indicators near the gap and that she was not informed by any employees or agents of SPG Houston Holdings about the dangerous condition. "Plaintiff was an invitee on the Premises," states the filing, emphasizing that Yeoh was there for mutual benefit during normal business hours.
The plaintiff accuses SPG Houston Holdings of negligence and premises liability. She contends that as owners and possessors of the property, they failed to maintain a safe environment for their business invitees. The complaint alleges that SPG Houston Holdings had either actual knowledge or should have reasonably known about the hazardous condition but did nothing to rectify it or warn visitors like Yeoh. "Defendant breached its duty of ordinary care to Plaintiff by failing to adequately warn Plaintiff of the condition and failing to make the condition reasonably safe," reads a key section of the document.
Yeoh is seeking compensation for various damages including past and future physical pain and disability, mental anguish, loss of earnings and earning capacity, medical expenses incurred from date of injury until trial, as well as anticipated future medical costs. The plaintiff's legal team has also requested pre-judgment and post-judgment interest in accordance with Texas Finance Code §304.001 et seq.
