Plaintiff sues grocery chain for alleged negligence after slip-and-fall injury

A grocery store slip-and-fall incident has escalated into a legal battle, as a plaintiff seeks substantial damages for severe injuries allegedly caused by the store's negligence. Chrisa Hunter filed a complaint against Kroger Texas, L.P., doing business as K034 Kroger East/Houston, in the District Court of Harris County, Texas on August 1, 2024.

The lawsuit stems from an incident that occurred on August 6, 2022, at approximately 6:00 p.m. Hunter claims she was walking through the Kroger store located at 360 Cypress Creek Parkway in Houston when she slipped and fell on a clear plastic bag left on the floor. The fall resulted in severe injuries to her chest that will require surgical intervention. According to the complaint, there were no efforts made to clean up the trash or maintain safe conditions in the store, nor were there any warning signs or staff present to alert customers of potential hazards.

Hunter asserts that she was an invitee at the time of the incident and that Kroger knew or should have known about the dangerous condition but failed to correct it or warn her. "Plaintiff did not have any knowledge of the dangerous condition," states the complaint, which alleges negligence on Kroger's part. The plaintiff argues that this negligence was a proximate cause of her injuries and is seeking monetary relief ranging from $250,000 to $1,000,000.

The lawsuit accuses Kroger of several negligent actions including failure to maintain safe premises, failure to inspect areas where dangerous conditions existed, failure to correct those conditions, and failure to inform customers like Hunter about such dangers. "Each of the foregoing negligent acts and/or omissions...was a proximate cause of Plaintiff's injuries and damages," reads the petition.

Hunter is seeking various forms of relief including past and future medical expenses, pain and suffering, mental anguish, physical impairment, and disfigurement. She also demands pre-judgment and post-judgment interest along with court costs.

Representing Chrisa Hunter is Todd Elias from Gordon & Elias LLP. The case has been assigned Case ID 2024-48752 and will be presided over by judges in Harris County’s 157th Judicial District Court.
