Construction Worker Sues Two Companies Over Negligence Leading to Severe Injuries

A Houston-based construction worker has filed a lawsuit against two companies, alleging negligence that led to severe injuries. Eduardo Ramirez filed the complaint in Harris County District Court on July 31, 2024, naming Ranked Windows LLC and Liberty Builders, Inc. as defendants.

According to the petition, Ramirez was working for Ranked Windows on June 15, 2023, performing remodeling and construction services at an apartment complex located at 4000 Watonga Blvd in Houston. The project was under the control of Liberty Builders. Ramirez claims he was instructed to work on a second-floor balcony using a ladder provided by the defendants. While on the ladder, it slipped, causing him to fall approximately twelve feet to the ground. The plaintiff asserts that the defendants failed to provide necessary safety equipment and training, which led directly to his injuries.

Ramirez's lawsuit details multiple allegations of negligence against both companies. He accuses Ranked Windows of failing to provide proper safety equipment and training for its employees and ignoring requests for assistance. "Defendants disregarded the safety of Plaintiff when they failed to provide proper instrumentalities and a safe workplace," states the petition. Similarly, Liberty Builders is accused of failing to inspect and maintain safe conditions at the worksite or warn of any hazards present.

The plaintiff seeks damages exceeding $250,000 but less than $1 million for medical expenses, physical pain and suffering, mental anguish, lost wages, and more. Additionally, Ramirez is asking for exemplary damages due to what he describes as gross negligence by both companies.

Representing Eduardo Ramirez are attorneys Scott P. Armstrong and Laura M. Gomez Duarte from Armstrong Lee & Baker LLP. The case has been assigned Case ID 2024-48309 in Harris County District Court with Judge Wanda Chambers presiding.
