Plaintiff Alleges Negligence Against Energy Company Following Severe Workplace Injuries

A Harris County resident has filed a lawsuit against a Delaware-based energy company, alleging severe injuries due to negligence at one of its facilities. Rolando Ibarra filed the complaint in the District Court of Harris County, Texas, on August 1, 2024, against Next Wave Energy Partners, LP.

According to the complaint, Ibarra was working as a pipefitter for Clough North America Holdings, Inc. at Next Wave Energy's facility in Houston on May 22, 2023. During his work, steam suddenly escaped from an adjoining pipeline causing severe burns and additional injuries to his neck, shoulders, and back due to the force and heat. The plaintiff claims that this incident could have been avoided if Next Wave Energy had properly trained and supervised its employees in controlling pipeline pressure and maintaining safety protocols.

The lawsuit outlines several allegations of negligence against Next Wave Energy Partners. These include failing to keep the pipeline in proper working order, requiring Ibarra to work in a dangerous location without adequate barriers or warnings about defective conditions. The complaint also accuses the company of failing to train and supervise their employees adequately and not maintaining a safe environment free from unreasonable risks.

Ibarra is seeking various forms of relief from the court. He demands compensation for physical pain and suffering experienced both in the past and anticipated in the future. Additionally, he seeks damages for medical expenses incurred and expected to incur due to his injuries. The plaintiff also requests compensation for disfigurement, physical impairment, mental anguish, loss of enjoyment of life, and punitive damages due to what he describes as gross negligence by Next Wave Energy Partners.

The case is being handled by Duncan Neblett Jr., an attorney with The Neblett Law Firm based in Houston. The case has been assigned Case ID 2024-48869 and will be heard in the 80th Judicial District Court under Judge Nelson Cuero.
