A recent court filing reveals a gripping case of alleged negligence that has left a woman seriously injured. Latavia Samuels filed a complaint against Memorial Hermann Health System in the District Court of Harris County, Texas, on July 31, 2024.
According to the court documents, Samuels claims she was severely injured on June 17, 2023, while visiting a property located at 16100 South Freeway in Pearland, Texas. The premises are reportedly owned and managed by Memorial Hermann Health System. Samuels alleges that she slipped on leaking water in the bathroom of the facility, resulting in significant injuries. She contends that as an invitee on the premises, Memorial Hermann owed her a duty of care to maintain a safe environment and warn her of any dangerous conditions. "Plaintiff was an invitee to whom Defendant owed a duty to use ordinary care," the complaint states.
The plaintiff argues that Memorial Hermann Health System failed in its responsibility to ensure the safety of its premises. She accuses the healthcare system of negligence for not addressing or warning about the hazardous condition that led to her fall. The lawsuit details how Samuels exercised appropriate caution at all times and did nothing to contribute to her injuries. The complaint further asserts that Memorial Hermann had actual or constructive knowledge of the dangerous condition but did nothing to mitigate it.
Samuels is seeking compensation for various damages including past and future physical pain and disability, mental anguish, medical expenses, physical disfigurement, and impairment. She has specified that she seeks monetary relief amounting to over $250,000 but less than $1 million. Additionally, she has requested a jury trial for this case.
