Employee Negligence Leads to Major Lawsuit Against Elevator Company

A shocking incident has led to a major lawsuit involving serious allegations of negligence. On July 31, 2024, Ana Nolasco filed a complaint in the District Court of Harris County, Texas against Kone Inc., operating as Kone Elevators and Escalators of North America, USA, and Houston.

According to the court documents, Ana Nolasco was injured on August 9, 2022, while working at her employer's location at 2401 Holcombe Blvd, Houston. The incident occurred when an employee of Kone Inc., who was present in the elevator with a ladder, mishandled it causing it to fall on Nolasco’s head and body. This accident resulted in severe and permanent injuries that required immediate medical attention and will likely necessitate ongoing treatment. "Plaintiff sustained serious and permanent injuries that have required medical treatment," states the filing.

Nolasco claims that her injuries were solely due to the negligence of Kone Inc. and its employees. She asserts that nothing she did or failed to do contributed to the incident. The plaintiff accuses Kone Inc. of failing to exercise due care in providing professional services at her workplace and neglecting their contractual duties which foreseeably led to injury. The document highlights multiple failures by Kone Inc., including improper handling of equipment, inadequate training of employees, failure to maintain a safe work environment, and gross negligence in hiring practices.

The plaintiff is seeking monetary relief exceeding $1 million for damages incurred from physical pain, mental anguish, loss of earnings capacity, disfigurement, and future medical expenses. Additionally, Nolasco demands exemplary and punitive damages citing gross negligence by Kone Inc., claiming their actions were carried out with "flagrant disregard for the rights of others."

Represented by Curtis J. Bickers from VB Attorneys based in Houston, Texas, Ana Nolasco has requested a jury trial for this case identified as Cause No. 2024-48583 before Judge Rhonda Momon in the 11th Judicial District Court.
