Mother Sues Property Management Company Over Child's Dog Attack Injuries

A mother is suing a property management company after her child was attacked by a dog on their premises. Latisha, individually and as next friend of Z.W., a minor, filed the complaint in Harris County Civil Court at Law No. 3 against Post Oak Multifamily TX LLC on August 8, 2024.

According to the court filing, Latisha alleges that Post Oak Multifamily TX LLC, a foreign limited company licensed to do business in Texas, failed to ensure the safety of its tenants by not controlling or removing a dangerous dog from its property. The incident occurred in apartment number 860, where Latisha's child was attacked and suffered injuries. The plaintiff argues that the defendant had both the knowledge and the legal right to impose conditions on the confinement of the dog or evict its owner but failed to take necessary actions.

The plaintiff asserts that Post Oak Multifamily TX LLC knew or should have known about the dangerous condition created by allowing a vicious animal on their property. Despite this knowledge, they allegedly did not exercise reasonable care to mitigate or eliminate the risks posed by the dog. The complaint details how this negligence led directly to the attack and subsequent injuries sustained by Z.W.

Latisha is seeking monetary relief for various damages including physical pain and suffering, medical expenses (both past and future), physical impairment, disfigurement, emotional distress, and out-of-pocket expenses. She has requested a jury trial and seeks both pre-judgment and post-judgment interest at the maximum legal rate along with all court costs.
