Employee Sues Foreign Corporation Over Workplace Injury

A Harris County resident has taken legal action against a foreign corporation for negligence leading to severe personal injuries. On August 7, 2024, Ilen Estrada Delgado filed a complaint in the District Court of Harris County, Texas, against WHC, L.L.C., alleging that the company’s negligence caused her significant harm while she was performing her job duties.

According to the court documents, Delgado claims that on December 20, 2022, while working for WHC, L.L.C., she suffered a severe injury when a skidder machine ran over her right foot and knocked her to the ground. The plaintiff asserts that WHC failed to provide adequate training and safety measures for operating such equipment. The complaint states: "WHC, L.L.C. failed to provide adequate training, failed to install proper safety devices, and/or failed to enact and enforce proper training procedures for the use of equipment." Delgado argues that these failures directly resulted in her injuries.

The plaintiff is seeking monetary relief exceeding $1 million. The lawsuit outlines various damages sought by Delgado including past and future medical expenses, physical pain and suffering, mental anguish, loss of earning capacity, loss of consortium, disfigurement, and property damage. She contends that the accident has had a profound impact on her life and will continue to do so in the future.

Delgado's attorney argues that WHC breached its duty of care by failing to maintain safe equipment and work conditions. Specific allegations include failure to inspect vehicles and equipment for dangerous conditions, failure to warn about such conditions, failure to eliminate hazards, inadequate employee training on equipment use and maintenance, and allowing unsafe conditions to persist. Each of these points is cited as contributing factors leading up to Delgado's injury.

In addition to compensatory damages for her injuries and suffering, Delgado is also seeking exemplary damages due to what she describes as WHC’s conscious indifference towards employee safety. Her legal team has demanded a jury trial and has requested all relevant documents from WHC be disclosed within 30 days as per Texas Rules of Civil Procedure.
