Nail Salon Sued Over Alleged Negligence Leading To Severe Injuries

A woman has filed a lawsuit against a nail salon and its owner, alleging severe injuries due to negligence. On August 7, 2024, Melinda Hull submitted her complaint in the District Court of Harris County, Texas, naming Tina Le, Heavenly Nails, and an unidentified individual as defendants.

The case revolves around an incident that occurred on August 8, 2022. Hull claims she was at Heavenly Nails for manicure and pedicure services when an employee negligently splashed water on the floor and failed to clean it up. The employee then allegedly instructed or allowed Hull to walk through the wet area, causing her to slip and fall violently. As a result, Hull sustained severe injuries to her head, back, and neck.

Hull asserts that the defendants had complete control over the premises and should have been aware of the dangerous condition. She argues that they failed to exercise reasonable care by not eliminating the risk posed by the wet floor. "Defendants knew or should have known about the dangerous condition on the Premises," states Hull in her petition. She further accuses them of violating internal safety standards by not using warning signs or maintaining safe walkways.

The plaintiff's petition outlines several points of negligence: failure to maintain a safe environment, inadequate employee training in cleaning procedures and maintaining safe walkways, failure to inspect for latent defects, and failure to warn or protect against dangers. Hull also alleges gross negligence due to what she describes as "a blatant, ongoing indifference to customer safety." She intends to present extensive evidence at trial showing Heavenly Nails' deliberate attempts to conceal liability and prevent her from obtaining emergency medical care.

Hull is seeking various forms of relief from the court. She requests judgment against the defendants within the jurisdictional limits of the court, pre-judgment and post-judgment interest as provided by law, exemplary damages for gross negligence amounting to fraud or malice, attorneys' fees, costs of suit, and any other relief deemed just by the court.
