Silvia Chicas, Aaron Holt, Nandini Sane, and Nicole Su will present “Understanding Legal and Practical Implications of Employee Political Activity” for members of the Houston Chapter of the Association of Corporate Counsel. With the presidential election right around the corner, workplaces across the country are likely to test the limits of polite discourse of politics in the workplace. These conversations can lead to a host of issues, including potential claims of employer discrimination, harassment, or retaliation. Additionally, with the rise of employee activism and demands for employers to take stands on hot button social issues of the day, employers should be prepared to proactively address these issues. Silvia, Aaron, Nandini, and Nicole will discuss both the legal obligations and practical advice for companies seeking to navigate this important topic, including answers to the following questions: 1. What are the political and social issues likely to be raised in the workplace?2. How should employers respond to employee requests to conduct a demonstration or hand out literature in the workplace? What are the legal implications of such a response?3. Can an employer limit employee speech on controversial political and social issues? What about t-shirts, buttons, and other messaging in the workplace?
