In a significant legal move, Harris County has filed a lawsuit against Riley’s Performance, LLC, over an incident that left one of its employees injured. The complaint was officially lodged by Harris County on August 14, 2024, in the District Court of Harris County, Texas.
The case revolves around an event that occurred on August 11, 2022. According to the court documents, a county employee was injured while performing her duties at Riley’s Performance located at 19620 Kuykendahl Road in Houston. The injury was allegedly caused by a loose wooden board on the premises that flew up and struck the employee's foot. Harris County asserts that Riley’s Performance had prior knowledge of this hazardous condition but failed to address it or warn visitors about the potential danger.
The plaintiff claims that as a result of this negligence, they had to provide workers' compensation benefits amounting to $1,194.07 for medical treatment of their injured employee. Citing Texas Labor Code Section 417.001 et seq., Harris County is exercising its subrogation rights to recover these costs from Riley’s Performance.
Harris County is seeking judgment against Riley’s Performance for the medical expenses incurred and is also requesting compensation for court costs and both prejudgment and post-judgment interest. The lawsuit underscores the county's commitment to ensuring safe working conditions for its employees and holding businesses accountable for maintaining safe premises.
