Construction Worker Sues Employer Over Negligence Leading To Severe Injuries

A Texas construction worker has filed a lawsuit against his employer, alleging severe injuries due to negligence at a work site. Esau Castillo filed the complaint in Harris County District Court on August 30, 2024, against Alliance Residential Builders, LP.

According to the court documents, Castillo was inspecting fire sprinklers at an apartment complex construction project located at 1575 League Line Road in Conroe, Texas, on January 4, 2023. During his inspection on the third floor of the building, he fell through an uncovered hole in the floor and sustained severe injuries. Castillo claims that Alliance Residential Builders were responsible for maintaining a safe work environment and failed to do so. "Defendants were in control of the work site and failed to keep the site free from hazards," stated Castillo in his petition.

The plaintiff asserts that he did nothing to cause the incident or his injuries. He accuses Alliance Residential Builders of multiple breaches of duty, including failing to inspect the work site and equipment where the dangerous condition existed, failing to warn him of the existence of such conditions, and not taking reasonable measures to eliminate these hazards. Castillo also claims that the company neglected its duty by allowing hazardous conditions to persist and not protecting workers from foreseeable risks.

Castillo is seeking monetary relief ranging from $250,000 to $1 million for various damages. These include past and future medical expenses, physical pain and suffering both past and future, physical impairment, loss of earnings and earning capacity, loss of consortium (including damages to family relationships), loss of household services, disfigurement, mental anguish both past and future, fear of future disease or condition, and costs related to medical monitoring and prevention in the future.

In addition to compensatory damages, Castillo is also seeking exemplary damages. He argues that Alliance Residential Builders' actions involved an extreme degree of risk considering the potential harm involved. Despite being aware of these risks, they proceeded with conscious indifference towards his safety.

The case is being handled by Kristin Zuniga from Marcos & Associates P.C., representing Esau Castillo. The presiding judge for this case has yet to be named under Case ID: 2024-58232.
