Houston Man Sues Local Bar Over Severe Injuries from Alleged Hazardous Condition

A Houston man has filed a lawsuit against a local business after suffering severe injuries due to an alleged hazardous condition on the premises. The complaint, filed by Ray Kanzig in Harris County District Court on September 5, 2024, names Diddi Enterprises Inc., doing business as CAPS Supper Club & Bar, and Two M.A.D. Investments as defendants.

According to the court documents, Kanzig was an invitee at CAPS Supper Club & Bar on May 31, 2024. Upon exiting his car and stepping onto the walkway in front of the establishment located at 2538 Briar Ridge Drive, Houston, TX 77057, he slipped on newly installed tiles and fell backward. The fall resulted in Kanzig hitting his head on the hard flooring, causing him to lose consciousness and sustain significant injuries including post-concussion syndrome and traumatic brain injury.

Kanzig asserts that the tiles were unfit for outdoor use due to their lack of traction and nonskid surface. "These tiles created an unreasonably dangerous condition," the petition states. The plaintiff claims that these conditions directly led to his injuries which required immediate emergency treatment and have left him with permanent pain and impairment.

The lawsuit further alleges that Diddi Enterprises Inc. and Two M.A.D. Investments failed to take necessary precautions or implement safety measures to mitigate the risk posed by the improperly installed tiles. Kanzig contends that the defendants had actual or constructive notice of this dangerous condition but did nothing to remedy it.

As a result of these allegations, Kanzig is seeking judgment against the defendants for actual damages exceeding $1,000,000.00. He is also requesting prejudgment interest, costs of suit, and any other relief deemed appropriate by the court.

Representing Kanzig is attorney John C. Clark from The John Clark Law Firm. The case has been assigned Case ID 2024-59892 and will be heard in Harris County's 80th Judicial District Court by Judge Nelson Cuero.
