A shopper is suing a major retail corporation for injuries sustained on their premises, alleging negligence and seeking substantial damages. Kawanah Gilmore filed a complaint against Wal-Mart, Inc. in the District Court of Harris County, Texas, on September 4, 2024.
According to the complaint, Gilmore was shopping at the Wal-Mart located at 11210 W. Airport Blvd., Stafford, Texas when she slipped on spilled sugar in one of the aisles. The incident resulted in serious bodily injuries for which Gilmore holds Wal-Mart responsible. She claims that the dangerous condition of the floor was something that Wal-Mart either knew about or should have known about through ordinary care.
The plaintiff argues that Wal-Mart had control over the premises and thus owed a duty to ensure it was safe for customers. The complaint states, "Defendant negligently permitted the floor to become slippery with spilled sugar," and further accuses Wal-Mart of failing to warn customers about the hazardous condition. Additionally, Gilmore asserts that the condition existed long enough that it should have been noticed and rectified by Wal-Mart employees if they had exercised proper care.
Gilmore's lawsuit seeks monetary relief amounting to $250,000 or less along with non-monetary relief. She is asking for compensation for past and future medical expenses, physical pain and suffering, mental anguish both past and future, as well as any other damages deemed appropriate by the court.
