Patient Alleges Negligence Against Multiple Healthcare Providers Following Discharge Incident

A woman has filed a lawsuit against several healthcare providers and institutions, alleging severe negligence that resulted in significant injuries. On September 5, 2024, Linda Greb filed her complaint in the District Court of Harris County, Texas, naming Mahmood O. Dweik, MD; Sumit Trivedi, NP; Clear Lake Hospitalists PA; CLS Health, PLLC; Mihaela Fetea, RN; Katherine Hillis, PT; Richard Varghese, PT; and CHCA Clear Lake L.P., doing business as HCA Houston Healthcare Clear Lake.

According to the complaint, on September 2, 2022, Linda Greb was admitted to HCA Houston Healthcare Clear Lake for a procedure to address hardware issues in her left knee. After being discharged on September 9, 2022, she was wheeled to her vehicle by hospital staff but was dropped during the transfer process. This incident led to a broken leg requiring surgical repair and further hospitalization. Greb alleges that the defendants' negligent conduct directly caused her severe injuries and damages.

The plaintiff claims that the healthcare providers failed in their duty of care by not adequately observing and treating her post-procedure condition. Specific allegations include failing to assess her ability to transfer into and out of a vehicle properly and not using appropriate techniques or equipment for assistance. The complaint states: "Defendants breached the standard of care by failing to adequately observe and treat Ms. Greb when she presented for care."

Greb is seeking monetary relief between $200,000 and $1 million for personal injuries resulting from medical negligence under Texas Civil Practice & Remedies Code §74.001 et seq. She is also requesting a jury trial and demands all costs of court, pre-judgment interest, post-judgment interest, and any other relief deemed just by the court.

The case is represented by attorneys John A. Davis Jr. and Steven R. Davis from Davis & Davis law firm. The presiding judge has yet to be named in this filing identified as Case No. 2024-59592.
