Tenant Sues Apartment Complex Over Negligence Leading to Severe Injury

A tenant is taking legal action against her apartment complex, alleging severe negligence that led to a significant injury. Gracie Baker filed a complaint in the Harris County District Court on September 5, 2024, against Summit Aspen Park Apartments Ltd.

According to the court documents, Baker claims that on December 10, 2023, she was transferring clothes from the washer to the dryer when a laundry room door suddenly detached from its frame and fell on her. The approximately 90-pound door struck her head and neck, causing substantial injuries. Baker asserts that Summit Aspen Park Apartments knew about the faulty and defective door due to wood rot and a dilapidated structure but failed to take corrective measures. She alleges that these hazardous conditions were ignored by the apartment management despite their duty to maintain safe premises for residents.

Baker's lawsuit accuses Summit Aspen Park Apartments of multiple counts of negligence and gross negligence. Specific allegations include failing to inspect and maintain the premises properly, allowing dangerous conditions to persist, and not warning tenants about known hazards. "Defendant breached the duty of care they owed to Plaintiff as a business invitee," states the complaint. Baker contends that this breach directly caused her injuries and subsequent medical treatments.

The plaintiff seeks various forms of relief from the court, including compensation for past and future medical expenses, lost wages, physical pain and suffering, mental anguish, physical impairment, disfigurement, and exemplary damages for gross negligence. The total amount sought exceeds $1 million.
