Homeowners' Association Sues Residents Over Unpaid Assessments

Woodland Lakes Owners Association, Inc. has filed a lawsuit against two property owners in Harris County, Texas, over unpaid assessments and related charges. The complaint was lodged on September 27, 2024, by the Woodland Lakes Owners Association in the Judicial District Court of Harris County against Colton Dampier and Presley Sage Deweese-Underwood.

The Woodland Lakes Owners Association is a non-profit corporation representing property owners within a specific community in Harris County. The defendants, Colton Dampier and Presley Sage Deweese-Underwood, own real estate at 24814 Crimson Pine Drive in Huffman, Texas. According to the complaint, this property is subject to certain covenants and restrictions recorded in the Real Property Records of Harris County. These regulations mandate that property owners pay regular assessments along with any interest, attorney fees, and other costs associated with late payments. The association claims that these financial obligations are necessary for maintaining community standards and amenities.

The plaintiff alleges that both defendants have failed to meet their financial obligations concerning these assessments. Despite multiple notices of delinquency sent to them by the association, the defendants have not paid their dues totaling at least $3,909.28. This amount includes past-due assessments as well as additional charges such as attorney's fees and accrued interest. The Woodland Lakes Owners Association asserts that it holds a lien on the defendants' property due to these unpaid charges and seeks legal permission to foreclose on this lien if necessary.

In its petition to the court, the association requests several forms of relief. They seek a judgment for all outstanding sums owed by the defendants, including any further amounts that may accrue during legal proceedings. Additionally, they request reimbursement for reasonable attorney's fees incurred while pursuing this action against Dampier and Deweese-Underwood. If successful in court, they also aim to establish and foreclose their lien on the property through an order of sale.
