Apartment Guest Alleges Negligence Against Property Owners After Injury

Valencia Howard has filed a lawsuit against three companies, alleging negligence after suffering injuries at an apartment complex. The complaint was filed by Valencia Howard in the District Court of Harris County, Texas, on September 25, 2024, against Westmount at London Park Houston, LP, Westmount Realty Group LLC, and Portico Property Management LLC.

The case revolves around an incident that occurred on July 13, 2024. Valencia Howard was visiting the Westmount at London Park apartment complex in Houston when she tripped over a white object protruding from a paved pathway. According to the complaint, this object caused her to fall and sustain serious injuries including fractures to her left ring and pinky fingers. The plaintiff claims that the defendants knew or should have known about this hazardous condition but failed to take appropriate action to rectify it or warn visitors. "Defendants failed to inspect this dangerous condition," states the complaint, further accusing them of neglecting their duty of care towards maintaining a safe environment for guests.

Howard's lawsuit asserts that as the owners and operators of the premises, the defendants were responsible for ensuring safety and warning about potential hazards. She accuses them of failing to inspect for dangerous conditions and not implementing adequate safety protocols. Moreover, Howard argues that the defendants' employees acted negligently within their scope of employment, making the companies liable under respondeat superior.

In her petition for relief, Howard seeks monetary compensation exceeding $1 million for damages including medical expenses, lost wages, pain and suffering, mental anguish, impairment, disfigurement, attorney’s fees, and punitive damages. She also demands a jury trial to resolve these claims.
