The incident in question occurred on July 24, 2024, when Gallegos visited a Walmart store located at 13003 Tomball Parkway in Houston. According to the petition, she was injured due to a hazardous condition at the store's exit area. The entrance door was temporarily blocked, forcing her to use the exit door. This dangerous condition allegedly led to her fall and subsequent injuries. Gallegos claims that Walmart had actual knowledge of this hazard as they were responsible for creating it and failed to rectify it or warn customers adequately.
Gallegos is seeking monetary relief exceeding $1 million for damages including medical expenses, physical pain and suffering, mental anguish, and physical impairment. She argues that Walmart's negligence in maintaining safe premises directly caused her injuries.
