Edgar Estuardo Cano Garcia has filed a lawsuit against two companies following a distressing incident at a junkyard in Houston, Texas. The complaint was filed on October 11, 2024, in the District Court of Harris County, Texas, naming Edinburgh Logistics Assets LLC and Pick A Part Auto Wrecking, L.P. as defendants.
According to the lawsuit, Edgar Estuardo Cano Garcia visited the junkyard on December 19, 2023. After paying an entry fee and beginning his search for car parts with his tool bag in hand, he encountered a hazardous situation. While examining a vehicle's air conditioning system, freon unexpectedly expelled onto his face and head. This incident caused him significant pain and temporary blindness. In need of urgent help, Garcia sought assistance from junkyard employees who allegedly responded with laughter rather than aid. Despite his evident distress and worsening condition—including nausea from the toxic exposure—an employee insisted on checking his tool bag for stolen parts before allowing him to leave to seek medical attention.
Garcia's lawsuit accuses Edinburgh Logistics Assets LLC and Pick A Part Auto Wrecking of negligence for failing to maintain safe premises and properly handle hazardous substances. He claims they did not provide adequate warnings about potential dangers or sufficient emergency assistance when needed. Furthermore, the plaintiff alleges that the defendants failed in hiring, training, and supervising their employees appropriately.
The lawsuit seeks damages exceeding $200,000 but not more than $1 million for various injuries sustained by Garcia due to the defendants' alleged negligence. These include loss of earnings both past and future; physical pain; mental anguish; medical expenses incurred so far and anticipated in the future; physical impairment; disfigurement; and other related costs.
