Restaurant Patron Alleges Negligence Against Dining Establishments Following Severe Injury

Cristina Soberano has taken legal action against several businesses following a severe injury she sustained at one of their establishments. On October 16, 2024, Soberano filed a complaint in the District Court of Harris County, Texas, against RCI Holdings, Inc., BMB Dining Services (Pearland), Inc., and Bombshells US 290. The lawsuit accuses these companies of negligence that led to her injuries.

The case stems from an incident on October 16, 2022, when Cristina Soberano visited a Bombshells restaurant in Harris County. While exiting the establishment, she tripped over a step in the parking lot and fell face-first, resulting in significant physical injuries. Soberano claims that nothing she did contributed to the accident and alleges that the defendants failed to maintain safe premises for their patrons. According to the petition, "Defendants knew or should have known of the danger posed by the step on its premises" and failed to warn patrons like Soberano about it.

Soberano's lawsuit outlines multiple instances of alleged negligence by the defendants. She accuses them of not providing verbal warnings or placing warning signs near the hazardous step. Additionally, she claims there was inadequate lighting in the area, which increased the risk of tripping for unsuspecting patrons. The complaint states that these failures amounted to negligence that directly caused her injuries and subsequent damages.

In her legal filing, Soberano seeks monetary relief exceeding $250,000 but not more than $1 million. She is asking for compensation for various damages including past and future physical pain and mental anguish, loss of earning capacity, medical expenses, disfigurement, and other consequential damages permitted by law. Furthermore, due to what she describes as gross negligence on part of the defendants—actions involving an extreme degree of risk with conscious indifference—Soberano is also pursuing exemplary damages.
