Texas Shopper Sues Grocery Chain Fiesta Mart Over Negligence Following Slip-and-Fall Incident

A Texas woman has filed a lawsuit against a prominent grocery store chain, alleging negligence after suffering injuries from a slip and fall incident. Jody Wortham filed the complaint on October 18, 2024, in the District Court of Harris County, Texas, against Fiesta Mart, LLC.

The case revolves around an incident that occurred on December 9, 2022, when Jody Wortham was shopping at Fiesta Mart Store #49 located at 4114 Fulton Street in Houston. According to the petition, Wortham slipped and fell due to a puddle of water near the ice machine inside the store. The fall resulted in personal injuries for which she is seeking damages. The plaintiff asserts that Fiesta Mart failed to maintain safe premises for its customers and accuses them of negligence under several legal doctrines including respondeat superior and vicarious liability.

Wortham's legal team argues that Fiesta Mart either knew or should have known about the hazardous condition that led to her accident. They claim that the store failed to warn her about the danger or make it reasonably safe. Furthermore, they accuse Fiesta Mart of failing to properly train employees and implement adequate safety protocols to prevent such incidents. The plaintiff contends these failures directly caused her injuries and seeks compensation for past and future medical expenses, pain and suffering, lost wages, disfigurement, physical impairment, as well as court costs and interest.

In terms of relief sought from the court, Wortham is requesting monetary damages ranging between $250,000 and $1 million as determined by a jury. She also seeks pre-judgment and post-judgment interest at the highest lawful rate until the judgment is fully satisfied.
