Customer Alleges Retail Giant Negligence After Slip-and-Fall Incident

Yolanda Benford Proctor has filed a lawsuit against a major retail corporation, alleging negligence and premises liability after a slip-and-fall incident at one of its stores. The complaint was filed on November 1, 2024, in the District Court of Harris County, Texas, naming Marmaxx Operating Corp as the defendant.

According to the court documents, Yolanda Benford Proctor claims that she was an invitee at a Marshalls & HomeGoods store located at 1425 W. Bay Area Blvd., Webster, Texas, on August 11, 2024. During her visit, she allegedly slipped and fell due to a hazardous substance or item on the floor. The plaintiff asserts that there were no warning signs posted about the potential hazard in this high-traffic area. She accuses Marmaxx Operating Corp of failing to maintain safe premises and neglecting to warn customers about dangerous conditions.

The lawsuit details several allegations against Marmaxx Operating Corp. It claims that the company had actual or constructive knowledge of the unreasonably dangerous condition but failed to take necessary precautions or provide adequate warnings to prevent harm. Proctor argues that the defendant's negligence in maintaining safe conditions directly led to her injuries. The complaint further accuses Marmaxx Operating Corp of failing to properly train employees in accident prevention and not implementing measures to ensure customer safety.

Proctor is seeking monetary relief for damages exceeding $250,000 but not more than $1 million. She is asking for compensation for past and future physical pain and suffering, mental anguish, medical expenses, disfigurement, physical impairment, and loss of enjoyment of life. Additionally, she requests both prejudgment and post-judgment interest as permitted by law.
