Industrial Workers Allege Negligence Against Texas-Based Company Following Refinery Incident

Luis Villasenor Ramirez and Cody Russell have filed a lawsuit against Onpoint Industrial Services, LLC, alleging negligence and gross misconduct that led to severe injuries. The complaint was filed on April 17, 2025, in the District Court of Harris County, Texas. The plaintiffs claim that Onpoint Industrial Services failed to ensure a safe working environment at a refinery in Martinez, California, leading to an incident on February 1, 2025.

According to the petition, both Luis Villasenor Ramirez and Cody Russell were working on scaffolding when they were exposed to flammable liquids and vapors due to Onpoint's alleged negligence. The plaintiffs argue that Onpoint did not adequately verify safety conditions or provide necessary equipment for their protection. As a result of these failures, the plaintiffs were trapped and forced to flee from dangerous conditions which resulted in them sustaining burns, exposure to toxic substances, and other injuries. They also accuse Onpoint of failing to provide adequate emergency response measures which exacerbated their suffering.

The lawsuit outlines several accusations against Onpoint Industrial Services including negligence in isolating flammable materials, failure to inspect equipment properly, inadequate training of employees, and insufficient emergency procedures. Furthermore, the plaintiffs assert that Onpoint's actions were grossly negligent as they showed a reckless disregard for safety despite being aware of the risks involved. They are seeking compensation for medical expenses, lost wages, pain and suffering among other damages totaling over $1 million.
