Pedestrian struck down in intersection brings driver to court

A Missouri resident filed a lawsuit against a Galveston woman alleging vehicular negligence.

Megan Prescott of St. Peters, Missouri, filed against Dominique Tipps in Galveston County District Court on June 8, claiming negligence in a June 2013 motor vehicle incident in Galveston.

According to the suit, Prescott was walking across 61st Street near its intersection with Seawall Blvd on or about June 13, 2013 when Tipps allegedly failed to yield the right of way when turning northbound onto 61st from Seawall Blvd. The complaint claims that the defendant struck the plaintiff, causing injuries.

Prescott claim that the defendant was negligent by failing to keep a lookout, control her speed, use her brakes, and turn or maneuver the car to avoid impact.

The grievance states that Prescott, age 23 at the time, sustained mental and physical pain; suffering, anguish and physical impairment; loss of ability to perform household services; and past and future lost wages and earning capacity.

The plaintiff seeks a sum within the Court’s jurisdictional limits; pre-judgment interest; attorney’s fees; expenses, and costs.
