A Jefferson County resident filed a lawsuit against the driver of a rig and his employer for alleged negligence in a February accident.
Asia Fisher filed a complaint against Pride Motor Carriers LLC of Austin, Texas and Aubrey Ellis of Houston, Texas in Jefferson County District Court on June 1, claiming liability in a roadway incident.
According to the suit, Fisher was traveling westbound on Wall Street on Feb. 10. The defendant was traveling southbound on MLK Boulevard, operating an 18-wheeler owned by Pride Motor Carriers. The suit alleged that Ellis disregarded a red traffic signal and slammed into the plaintiff’s vehicle.
The grievance alleged that Fisher suffered severe bodily injuries to her back, neck and other areas; physical pain and mental anguish; impairment and medical expenses; and lost wages and lost earning capacity.
Asserting that the driver was negligent in failing to maintain a safe distance, speed and lookout, and neglecting to stay alert, apply his brakes, and swerve or otherwise avoid impact, the plaintiff also contends that Pride was negligent in entrusting its vehicle to an allegedly incompetent and reckless driver.
Fisher seeks more than $1 million in damages; pre- and post-judgment interest; and attorney’s fees, expenses and costs. She is represented by Cade Bernsen and Cody Rees of the Bernsen Law Firm in Beaumont, Texas.
