Suit seeking $1 million for car crash placed on court’s October docket

Unless the case is mediated, a suit brought by a Madison County woman seeking more than $1 million against a Jefferson County woman for an alleged crash on state Highway 75 will go to trial sometime in October.

As previously reported, Phyllis Green Taylor filed a lawsuit against Jaclyn Nicole Carpenter on Aug. 18 in Jefferson County District Court.

Court records show that an agreed discovery control plan was filed in the case on Dec. 29, calling for the case to be mediated by July 28 or go to trial in October.

The suit alleges the crash happened Dec. 27, 2012, at the intersection of state Highway 75 and Interstate Highway 45 when Carpenter crashed into Taylor’s vehicle.

Taylor accuses Carpenter of negligence for allegedly failing to operate the vehicle with proper care necessary to avoid the collision. She is asking for more than $1 million in damages for medical expenses, physical pain, mental anguish, disfigurement, physical and mental impairment and loss of earnings.
